DIREITOS HUMANOS E A TEORIA DE DIREITO CONTEMPORÂNEA

RESUMO

O presente artigo pretende analisar o debate jurídico contemporâneo tanto dos direitos humanos quanto da teoria do direito contemporânea, especialmente a decorrente do pensamento de Ronald Dworkin. Assim, demonstrando a evolução histórica dos direitos humanos, chegamos à conclusão de que a fundamentação para os direitos humanos está no princípio da dignidade da vida humana. Adotando a teoria universalista de confluência para os direitos humanos, tentamos definir o conceito de dignidade humana como um conceito interpretativo construtivo, a ser observado na forma de vida compartilhada, conforme orienta a teoria do direito de Dworkin e demonstrar os limites para a obtenção de tal conceito devido ao conceito de soberania.

ABSTRACT

The present article intends to analyze the contemporary legal debate about the human rights and the contemporary law theory, specifically from the thought of Ronald Dworkin. Thus, by the demonstration of the historical evolution of human rights, we came to the conclusion that the foundation for human rights is based in the principle of the dignity of human life. By the adoption of the universalist theory of confluence for human rights, we try to define the concept of human dignity as a constructive interpretive concept, to be observed in the shared life form, according to Dworkin's theory of law, and to demonstrate the limits for obtaining such concept due to the concept of sovereignty.
