CONTRATO PADRÃO COMO INSTRUMENTO DE PROTEÇÃO AO CONSUMIDOR NAS INCORPORAÇÕES IMOBILIÁRIAS

O presente artigo científico trata da proteção do direito do consumidor na aquisição de imóveis edificados em regime de incorporação imobiliária. Busca-se esclarecer o papel da serventia de Registro de Imóveis na fiscalização do procedimento de incorporação imobiliária e de que forma pode-se garantir que o adquirente de imóveis nesta modalidade não seja vítima de cláusulas contratuais abusivas. Sugere-se que o depósito prévio do contrato-padrão no procedimento de registro de incorporação imobiliária pode obstar cláusulas abusivas prevenindo uma série de demandas no Poder Judiciário.

ABSTRACT

This article deals with the protection of consumer rights in the acquisition of real estate properties. It seeks to clarify the role of the use of Real Estate Registry in the supervision of the procedure of real estate development and in what way can be guaranteed that the acquirer of real estate in this modality is not a victim of abusive contractual clauses. It is suggested that the previous deposit of the standard contract in the process of registration of real estate development can prevent abusive clauses preventing a series of demands in the Judiciary.
