RESPONSABILIDADE EMPRESARIAL E A NACIONALIZAÇÃO DO TRABALHO: UMA REVISÃO DO TEMA

Resumo

RESUMO: O Estado brasileiro, no exercício de sua soberania, permitiu ao longo de sua história a imigração de trabalhadores para povoamento e ocupação de suas terras. Ao longo do tempo, novos fluxos migratórios se desenharam no cenário brasileiro. A participação do Brasil no contexto mundial e sua ascendência econômica motivou o ingresso de estrangeiros em seu território na atualidade. O ingresso de trabalhadores italianos marcou o início do século XX no Brasil. As implicações sociais da vinda destes trabalhadores no contexto brasileiro foi inevitável. O caráter político e a firmeza de suas convicções políticas fizeram com que, quando da elaboração da Consolidação das Leis do Trabalho, fosse introduzido o art. 352. Este artigo prevê a política de nacionalização dos postos de trabalho à época, assegurando aos nacionais 2/3 das vagas de trabalho. As indagações surgem em decorrência da mudança da ordem constitucional e como se comporta a legislação trabalhista da década de 1940 nos dias atuais.

ABSTRACT: The Brazilian State, in exercise of its sovereignty, allowed throughout its history the immigration of workers to settlement and occupation of their lands. Over time, new migration flows were designed in the Brazilian scenario. Brazil's participation in the global context and its economic ascendancy motivated the entry of foreigners in its territory today. The entry of Italian workers marked the beginning of the twentieth century in Brazil. The social implications of the coming of these workers in the Brazilian context was inevitable. The political character and the strength of their political beliefs meant that, when drafting the Consolidation of Labor Laws, was introduced to art. 352. This article provides for the nationalization policy of jobs at the time, ensuring national 2/3 of the openings jobs. The questions arise due to the change of the constitutional order and behaves the labor legislation of the 1940s nowadays.
