ACORDO TRIPS NO SÉCULO XXI: INSTRUMENTO ESTRATÉGICO PARA A EFETIVAÇÃO DO LIVRE COMÉRCIO DOS PAÍSES EMERGENTES.

A criação da Organização Mundial do Comércio é um marco relevante para o livre comércio entre as nações. A partir do advento da OMC foi estabelecido o Acordo TRIPS, importante instituição para a Propriedade Intelectual, com o intuito de garantir a proteção e desenvolvimento das matérias relativas a essa especialidade. Recentes teorias do comércio internacional acreditam que o setor tecnológico, especificamente a transferência de tecnologia, será importante matéria na estratégia comercial de empresas multinacionais. A indagação feita no presente trabalho é a efetividade dos termos do Acordo TRIPS, quando se trata da proteção dos produtos de países em desenvolvimento, trazendo como exemplo a derrelição de um Indicador Geográfico de origem indiana.

Abstract:

The creation of the World Trade Organization is an important step for the free trade between nations.Since the advent of the WTO was established the TRIPS Agreement, which is an important institution for the Intellectual Property, with the aim of ensuring the protection and development of the matters relating to this skill. Recent theories of international trade believe that the technology industry, specifically the transfer of technology, will be important in the commercial strategy of multinational companies. The inquiry made by the present study is the effectiveness of the terms of the TRIPS Agreement, when it comes to the protection of the products of developing countries, bringing as an example the lack of protection of a Geographical Indication of Indian origin.
