A JUDICIALIZAÇÃO “TOTAL” DAS RELAÇÕES SOCIAIS: UMA ANÁLISE FENOMENOLÓGICA A PARTIR DO CAMPO JURÍDICO PROFISSIONAL

Trata-se de uma pesquisa fenomenológica sobre a questão da judicialização “total” das relações sociais. Entende-se esse fenômeno como sendo o processo complexo de expansão do direito para todos os campos da vida social. Aborda-se a questão, principalmente, a partir da interpretação do comportamento dos agentes engajados nas atividades do campo jurídico profissional. Conclui tratar-se de dado cultural que materializa certo “espirito” do nosso tempo e que o seu enfrentamento deve se dar pelo resgate da autonomia de outras instâncias sociais não necessariamente estatais, ou seja, que o enfretamento se dá pela ênfase na liberdade e responsabilidade humana.

ABSTRACT

This is a phenomenological research about the “total” judicialization of the social relations. This phenomenon is understood as a complex process of expansion of law through all fields of the social life. It approaches the matter, mainly, by the interpretation of the behavior of the agents engaged in activities in the juridical field. It concludes that the total judicialization is a cultural phenomenon and that it materialize our zeitgeist and that the situation may be faced by restoring the autonomy of others social instruments, that is, this subject should be faced emphasizing the human liberty and responsibility.
