A PERDA DE CHANCE NO MANDATO FORENSE: ANÁLISE DA RESPONSABILIDADE CIVIL SOB A PERSPECTIVA JURÍDICA EUROPEIA E BRASILEIRA

RESUMO

O contrato de mandato (in casu, o mandato forense) encontra-se legalmente regulamentado pela lei civil e é de conhecimento generalizado. Tendo o mandatário depositado todos os seus interesses e confiança na arte, sabedoria e experiência do mandatário, quid iuris, se este, por qualquer motivo não age conforme as leges artis e com isso cria danos (ir)reparáveis para o mandante. Será o mandante o elo mais fraco? Ficará o dano com quem o sofre (mandante) – Casum sentit dominus? Nesse sentido, dedica-se o presente artigo científico ao estudo aprofundado e reflexão conferido a matéria em âmbito jurídico europeu, com abordagens ao direito comparado,  dedicando especial tópico ao tratamento jurídico-positivo conferido pelo ordenamento jurídico brasileiro.

ABSTRACT

The mandate contract (in casu, the forensic mandate) is legally regulated by the civil law and is well knowledge. If the representative deposited all his interests and confidence in art, wisdom and experience of the agent, quid iuris (?) if, for any reason he does not act according to the leges artis and thus creates irreparable damage to the customer. It will be the customer the weakest link? Will be the damage with whom suffers (customer) – casum sentit dominus? In this sense, the present scientific article is dedicated to the in-depth study and reflection conferred on the matter in a European juridical context, with approaches to comparative law and devoting a special topic to the legal-positive treatment conferred by the Brazilian legal system.
