A RESPONSABILIDADE DAS EMPRESAS PRODUTORAS DE VACINAS EM FACE DO DIREITO AMBIENTAL CONSTITUCIONAL BRASILEIRO

Resumo

Objetivo: O objetivo deste artigo foi analisar a questão da responsabilidade das empresas produtoras de vacinas em face do direito ambiental constitucional brasileiro principalmente em decorrência do inicio da pandemia de COVID-19 no Brasil ocorrida em 2020.

Metodologia: A pesquisa foi estruturada bem como realizada a partir do método hermenêutico, por meio do levantamento dos trabalhos doutrinários elaborados por estudiosos especializados atuantes no âmbito da matéria investigada e da análise jurídica vinculada ao direito ambiental constitucional com especial atenção para a tutela jurídica da saúde ambiental em face do direito empresarial ambiental assim como das normas infraconstitucionais tudo com o objetivo de adequar de forma satisfatória o enquadramento do tema em face de nosso sistema jurídico em vigor.

Resultados: Restou claramente demonstrado que a responsabilidade das empresas produtoras de vacinas em face do direito ambiental constitucional brasileiro, interpretada dentro de contexto constitucional que recepciona a saúde ambiental no plano constitucional do meio ambiente, está vinculada aos princípios gerais constitucionais da atividade econômica desenvolvido com fundamento na ordem jurídica do capitalismo com destaque para a defesa do meio ambiente (Art.170 VI da CF).

Contribuições: A principal contribuição deste estudo foi a de estabelecer objetivamente que as empresas produtoras de vacinas, em face de seu superior enquadramento normativo balizado pelo direito empresarial ambiental brasileiro, submetem-se aos princípios da prevenção, da precaução, do poluidor-pagador inclusive com a necessária obediência ao instrumento constitucional do Estudo Prévio de Impacto Ambiental subordinando-se inclusive, no plano da responsabilidade criminal, ao que determina o Art.225,§ 3º de nossa Lei Maior.

ABSTRACT

Objective: The objective of this article was to analyze the question of the responsibility of companies that produce vaccines in the face of Brazilian constitutional environmental law, mainly due to the beginning of the pandemic of COVID-19 in Brazil that occurred in 2020.

Methodology: The research was structured as well as carried out using the hermeneutic method, through the survey of the doctrinal works prepared by specialized scholars working in the scope of the investigated matter and the legal analysis linked to the constitutional environmental law with special attention to the legal protection of health in the face of environmental business law as well as infraconstitutional rules, all with the objective of satisfactorily adapting the framework of the theme in the face of our current legal system.

Results: It remains clearly demonstrated that the responsibility of vaccine manufacturers in the face of Brazilian constitutional environmental law, interpreted within the constitutional context that welcomes environmental health at the constitutional level of the environment, is linked to the general constitutional principles of economic activity developed on the basis of in the legal order of capitalism with emphasis on the defense of the environment (Art.170, VI of the CF).

Contributions: The main contribution of this study was to establish objectively that vaccine-producing companies, in view of their superior regulatory framework guided by Brazilian environmental business law, are subject to the principles of prevention, precaution, polluter pays, including with the necessary obedience to the constitutional instrument of the Preliminary Study of Environmental Impact, also subordinating itself, in terms of criminal responsibility, to what is determined by Art.225, § 3 of our Major Law.
