O PRINCÍPIO DA DIGNIDADE HUMANA COMO SALVAGUARDA DA PROTEÇÃO AO REFUGIADO

Hanna Arendt sintetizou a condição dos refugiados em uma frase bastante polêmica à sua época, dizendo que os escravos tinham pelo menos os direitos típicos de escravos, já os refugiados não tinham direito algum. Os refugiados são o que Giorgio Agamben chamou de humanidade nua, sem qualquer direito, apenas humanos. Na atualidade, o que resta em um ser humano sem direitos que obriga a sociedade a protegê-lo independente de uma lei? Os direitos humanos atuais têm sido no sentido de que não há seres humanos melhores do que outros e que se há algo inerente à condição humana é a dignidade. O presente artigo tem a intenção de demonstrar a dignidade da pessoa humana como base moral dos direitos humanos e, especialmente, como alicerce da proteção daqueles que deixaram de ter um Estado garantidor e ficaram à mercê do reconhecimento de sua humanidade. Para tanto, o método empregado é o dedutivo e o critério de pesquisa o bibliográfico. Inicia-se com a contextualização da dignidade da pessoa humana, passando-se a uma abordagem histórica dos direitos humanos e, nessa esteira, terminando com uma análise dos elementos legislativos que destinam tutela aos refugiados baseados na dignidade da pessoa humana.

ABSTRACT

Hanna Arendt summed up the condition of the refugees in a very controversial phrase to their time saying that the slaves had at least the rights of slaves, the justification for refugees had no right. Refugees, therefore, are what Giorgio Agamben called naked humanity, without any right, only human. At present, what remains in a human being without rights that obliges society to protect it independent of a law? Current human rights have been in the sense that there are no better human beings than others and that if there is something inherent in the human condition it is dignity. The purpose of this article is to demonstrate the dignity of the human person as a moral basis for human rights and, in particular, as a foundation for the protection of those who cease to have a guarantor state and who have been granted the recognition of their humanity as an overriding their being Welcomed.
