RESUMO

O presente estudo tem como objetivo analisar os aspectos históricos relacionados aos negócios fiduciários, especialmente aqueles que desempenham função de garantia. Concebidos pelo direito romano eram inicialmente pautados exclusivamente na confiança. Entretanto, foram as novas perspectivas traçadas pelo direito germânico que permitiram a compreensão dos elementos intrínsecos e caracterizadores do atual negócio fiduciário. A influência do direito romano e germânico propiciaram a concepção do negócio fiduciário moderno – um instituto largamente utilizado pelos diversos ordenamentos jurídicos, que adaptado às exigências reclamadas, serve como meio para suprir lacunas dos sistemas jurídicos vigentes e permitir o surgimento de novas figuras com base numa estrutura fiduciária.

ABSTRACT

The current study aims to analyze the historical aspects related to the fiduciary business, especially those that perform guarantee function. Created by the Roman law they were initially based on confidence. Nevertheless the most recent contributions from German law allowed the comprehension of intrinsic elements that currently illustrate fiduciary business. The influence of Roman and German law enabled the origin of modern fiduciary business – an institute widely used by several legal systems which adapted to the claimed requirements serves as way to fill gaps and allows arise the new instruments based on fiduciary structure.
