MULHER, ESTRANHA E CONDENADA: SOBRE AS IMIGRANTES QUE CUMPREM PENA PRIVATIVA DE LIBERDADE NO BRASIL

O estudo a seguir exposto tem por intuito discutir a situação de vulnerabilidade na qual se encontram as estrangeiras encarcerada no Brasil, considerando as muitas circunstâncias que dificultam a contemplação de seus direitos. Para tanto, o texto discute a condição jurídica da pessoa estrangeira ante ao sistema jurídico brasileiro, as peculiaridades da pessoa estrangeira frente à pena privativa de liberdade e, por fim, os entraves sofridos pelas mulheres submetidas ao cárcere, para que seja possível refletir sobre o quão vulnerável torna-se a situação da estrangeira submetida ao sistema prisional. O estudo realiza-se por meio de pesquisa bibliográfica de caráter dedutivo. Importa dizer que as discussões são pautadas teoricamente em corrente criminológica crítica, com especificidades do recorte de gênero.

ABSTRACT

The purpose of this study is to discuss the situation of vulnerability in which incarcerated foreign women are in Brazil, considering the many circumstances that hider the contemplation of their rights. Therefore, the text discusses the legal status of the foreigner before the Brazilian legal system, the peculiarities of the foreigner in face of incarceration and, finally, the obstacles suffered by women submitted to prison, so that it is possible to reflect on the how vulnerable the situation of the foreigner submitted to the prison system becomes. The study is carried out by a bibliographic research of a deductive character. It is important to say that the discussions are based theoretically on a critical criminological current, with specificities of the gender cut.
