DEZ ANOS DE LEI MARIA DA PENHA: A IMPORTÂNCIA DA PERSPECTIVA DE GÊNERO NO ENFRENTAMENTO DA VIOLÊNCIA

Este artigo analisa a importância da perspectiva de gênero para interpretação e aplicação da Lei Maria da Penha, tendo em vista que a categoria gênero compõe o núcleo estruturante da norma. A lei criou mecanismos para coibir e prevenir a violência doméstica e familiar contra a mulher, estabelecendo medidas de assistência, atendimento e proteção, assim como apontando para a importância de compreender a violência de gênero como resultado das desigualdades socialmente construídas. Contudo, a conceituação e a incorporação da perspectiva de gênero, pouco discutida ou utilizada no meio jurídico, podem dificultar sua interpretação e gerar incertezas acerca da aplicação da lei.

ABSTRACT

This paper analyzes the importance of the gender perspective to the interpretation and application of the Maria da Penha Law, given that the gender category integrates the structural core of the rule. The law has created mechanisms to restrain and prevent domestic and family violence against women, establishing support measures, care and protection, as well as pointing to the importance of understanding gender violence as a result of socially constructed inequalities. However, the concept and the integration of a gender perspective, little discussed or used in the legal environment, can hinder their interpretation and generate uncertainty about the application of the law.
