O BRASIL E O SISTEMA INTERAMERICANO DE DIREITOS HUMANOS: DE NOGUEIRA DE CARVALHO À GUERRILHA DO ARAGUAIA

RESUMO

O Sistema Interamericano de Direitos Humanos, criado no âmbito da Organização dos Estados Americanos, se efetivou com a celebração da Convenção Americana de Direitos Humanos em 1969. A assinatura dessa Convenção não só avigorou o sistema de proteção dos direitos humanos, ao atribuir mais efetividade à Comissão, como também criou a Corte Interamericana. Por cinco vezes o Brasil foi demandado na Corte Interamericana de Direitos Humanos por violar ou negligenciar tais direitos em seu território. Propõe-se, no presente trabalho, analisar e estudar tais demandas e suas influências na promoção da efetividade dos direitos humanos.

ABSTRACT

The Inter-American System of Human Rights, created within the Organization of American States, was accomplished with the celebration of the American Convention on Human Rights in 1969. The signature of this Convention not only invigorated the system of protection of human rights, to assign more effectiveness to the Commission, but also created the Court. Five times Brazil was sued in the Court of Human Rights for neglect or violating such rights in its territory. It is proposed in this paper the analysis and the study of these demands and its influences in the promotion of human rights.
