Apontamentos sobre o conceito de Lex Mercatoria.

Abstract

RESUMO

A noção do que venha a ser a Lex Mercatoria precisa passar por reavaliação. Em algum sentido os fenômenos globalizantes contemporâneos acabaram difundindo a ideia de que existiria um conjunto normativo próprio a reger as atividades empresariais transnacionais, libertando-as dos entraves do Direito nacional. Tal conceito, contudo parecer ser lastreado em compreensão equivocada das origens do Direito comercial.

ABSTRACT

The notion of what would be the Lex Mercatoria must undergo reassessment. In some sense the contemporary globalizing phenomena is spreading the idea that there would be a proper law to govern the transnational business activities, freeing them from the national law barriers. That concept however, appears to be backed by misunderstanding of the origins of the Commercial Law.
