RESGATANDO A IMPORTÂNCIA DA TRANSAÇÃO COLETIVA DE CONSUMO NO BRASIL

O artigo se propõe a identificar as virtudes da transação coletiva nas relações de consumo como método eficaz para a prevenção e solução de conflitos, rompendo-se com toda uma tradição de dependência ao modelo de solução judicial, partindo-se da análise de experiências bem-sucedidas nos Estados Unidos e Holanda, passando pelo resgate da importância do Termo de Ajustamento de Conduta, enquanto modelo de transação extrajudicial. Rediscute-se, também, a abertura de uma nova perspectiva processual de valorização da conciliação e mediação, resgatando as virtudes do Projeto de Lei 282/2012, tudo de modo a blindar a posição jurídica do consumidor, sobretudo quando identificado no plano transindividual como categoria econômica e juridicamente fragilizada.

ABSTRACT

The article proposes to identify the virtues of the collective transaction in consumer relations as an effective method for the prevention and resolution of conflicts, breaking with a whole tradition of dependence on the model of judicial solution, starting from the analysis of well- In the United States and the Netherlands, and to recover the importance of the Term of Adjustment of Conduct as an extrajudicial transaction model. The opening of a new process of valuation of conciliation and mediation is also discussed, rescuing the virtues of Bill 282/2012, all in order to shield the legal position of the consumer, especially when identified in the plan as transindividual economically and legally fragile category.
