A RELAÇÃO ENTRE A FUNÇÃO SOCIOAMBIENTAL DA PROPRIEDADE E OS DIREITOS HUMANOS – O PAGAMENTO POR SERVIÇOS AMBIENTAIS (PSA)

RESUMO

Com a apropriação dos bens dispostos na natureza pelo homem, tem início uma longa discussão que persiste até os dias hodiernos, acerca dos limites do exercício do direito de propriedade, que, originariamente revestia-se de caráter absoluto, sendo relativizando ao longo do tempo, especialmente no Brasil com o advento da Constituição Federal de 1988. O referido texto constitucional, absorvendo o conceito de função social da propriedade, condicionou o exercício desse direito ao cumprimento de determinadas obrigações, positivas ou negativas, em favor da sociedade, condicionantes essas que foram evoluindo até açambarcar o conteúdo ambiental, exsurgindo o conceito de função socioambiental da propriedade, como corolário da efetivação dos direitos humanos. Dentre o manancial de instrumentos apresentados ao longo do tempo, o Pagamento por Serviços Ambientais (PSA) mereceu especial destaque, razão pela qual foi incluído no presente trabalho, de modo que, o desafio proposto foi estabelecer o liame entre a função socioambiental da propriedade e os direitos humanos e a importância do PSA na sua efetivação e afirmação.

ABSTRACT

With the appropriation of the goods disposed in nature by man, a long discussion begins, which persists even today, about the limits of the exercise of the right of property, which was originally of an absolute character, being relativized throughout the Time, especially in Brazil with the promulgation of the Federal Constitution of 1988. The aforementioned constitutional text, absorbing the concept of social function of property, conditioned the exercise of this right to the fulfillment of certain obligations, positive or negative, in favor of society, which evolved to include environmental content, exasperating the concept of socio-environmental function of property, as a corollary of the realization of human rights. Among the number of instruments presented over time, the Environmental Services Payment (PSA) deserved special mention, which is why it was included in the present study, so that the proposed challenge was to establish the link between the socio-environmental function of the property and Human rights and the importance of the PSA in its implementation and affirmation.
