DIREITO À CULTURA: A NECESSIDADE DE COMPREENSÃO CONCEITUAL JURÍDICA PARA SUA GARANTIA E IMPLEMENTAÇÃO ATRAVÉS DE POLÍTICAS PÚBLICAS

O presente trabalho busca compreender as proximidades e distâncias entre o conceito antropológico e sociológico de cultura e o conceito constitucional dos direitos culturais e à cultura. A temática é relevante por buscar elucidar especialmente aos gestores públicos o que a constituição federal quer proteger com a garantia da ordem cultural, bem como para esclarecer o direcionamento de recursos a políticas públicas culturais. A abordagem utilizada foi a dedutiva e a coleta de dados foi bibliográfica e empírica, através de levantamento de editais de direcionamento de recursos pelo Ministério da Cultura – MinC. Percebeu-se com o estudo que o conceito constitucional de cultura não é claro, que os direitos culturais são pouco discutidos judicialmente, que os editais do MinC privilegiam projetos relacionados com desenvolvimento regional, nacional, ações afirmativas e a cultura erudita.

ABSTRACT

The essay aims to understand the distances and approaches between the sociological and antropological concepts of culture and the constitutional concept of cultural rights and right to culture.  The subject is relevant because it tries to elucidate specially to public managers what the federal constitution protects within the cultural order warranties. The approach used was the deductive and the data were collected in bibliographyc way and in empiric way by uplifting the public edicts to resources distribution of the Ministery of Culture – MinC.  It was realized by the study that the constitutional concepto f culture is not clear, and that the cultural rights are not very discussed in court. It was also realized that the MinC edicts priviledge the projects related to regional and national development, affirmative actions and classical culture.
