HERANÇA DIGITAL E O CASO ELIS REGINA: IMPLICAÇÕES JURÍDICAS NO USO DA IMAGEM DE PESSOAS MORTAS PELA INTELIGÊNCIA ARTIFICIAL

Resumo

OBJETIVO: Verificar se a utilização de recursos de Inteligência Artificial (AI) no tocante a imagem de pessoas mortas, fere a honra do falecido, ainda que autorizado pelos seus herdeiros legais, a partir da análise do comercial envolvendo a cantora Elis Regina, bem como, entender o papel do estudo da herança digital, conceituando-o e aplicando num cenário em constante evolução tecnológica.

METODOLOGIA: utiliza-se o método dedutivo e de forma auxiliar o método comparativo, mediante revisão bibliográfica e conceitual de documentos que abordam tal temática, por meio de leitura de artigos científicos, obras e textos legais, cujo escopo é compreender a relação da utilização da inteligência artificial, o direito e a herança digital, sendo está uma temática nova para o ordenamento jurídico.

RESULTADOS E CONTRIBUIÇÕES: Buscando compreender a utilização de recursos de Inteligência Artificial (AI) quanto a imagem de pessoas mortas, fere a honra do falecido, ainda que autorizado pelos seus herdeiros legais, é possível concluir que a utilização de recursos de Inteligência Artificial (IA) na imagem de pessoas mortas pode gerar preocupações éticas sobre a violação da honra do falecido, mesmo que autorizado pelos herdeiros legais.  Logo, percebe-se que a manipulação da imagem do falecido pode distorcer sua percepção pública e afetar sua memória e legado. A autorização dos herdeiros não necessariamente elimina as questões éticas envolvidas nesse tipo de uso da IA, salvo se houver alguma ressalva em testamento deixado por ele.

ABSTRACT

OBJECTIVE: This study aims to investigate whether the utilization of Artificial Intelligence (AI) resources in handling images of deceased individuals infringes upon the honor of the deceased, even when authorized by their legal heirs. The investigation is conducted through the analysis of a commercial involving the singer Elis Regina. Additionally, the study aims to elucidate the role of digital inheritance in a rapidly evolving technological landscape.

METHODOLOGY: The research employs a deductive method supplemented by a comparative approach. It involves a comprehensive review of literature and concepts related to the topic, encompassing scientific articles, legal texts, and works that address the subject matter. This investigation seeks to comprehend the relationship among the use of AI, legal aspects, and digital inheritance, as the latter is a novel subject within legal frameworks.

RESULTS AND CONTRIBUTIONS: Through the exploration of AI utilization in posthumous individuals' images and its potential infringement upon their honor, even with legal heirs' consent, it becomes evident that ethical concerns arise regarding the violation of the deceased's dignity. The manipulation of posthumous images by AI has the potential to distort their public perception and impact their memory and legacy. Authorization by legal heirs does not necessarily mitigate the ethical quandaries associated with such utilization of AI, unless explicitly addressed in a testament or will. This study sheds light on the complex intersection of AI, legal considerations, and the preservation of the digital legacy of deceased individuals.
