DIREITO E NOVAS TECNOLOGIAS: A APLICABILIDADE DOS DIREITOS HUMANOS NO MUNDO ONLINE E A NECESSIDADE DE EFETIVÁ-LOS NA SOCIEDADE DIGITAL

Resumo

Objetivo: Diante da necessidade de evolução do Direito para lidar com as novas demandas trazidas pela Era Digital e a efetivação dos direitos humanos digitais, o presente artigo tem como objetivo analisar como os direitos humanos se manifestam no mundo digital e a necessidade de aplicá-los online.

Metodologia: Para alcançar o resultado esperado, utiliza-se na presente pesquisa o método dedutivo e uma metodologia descritiva, documental e bibliográfica.

Resultados: O artigo propõe uma reflexão sobre os conceitos e expressões da globalização alterados pelas novas tecnologias, com enfoque na Internet e na reorganização da sociedade em torno de um mundo digital, para alcançar o propósito de afirmar que os direitos humanos devem ser respeitados, promovidos e exercidos pela sociedade em geral.

Contribuição: A pesquisa apresenta a análise da necessidade de compreensão científica, na atual sociedade digital, de que os direitos humanos, usufruídos pelas pessoas no mundo off-line, também sejam respeitados no mundo online como efetivação dos direitos humanos.

ABSTRACT

Objective: In view of the need for the evolution of Law to deal with the new demands brought by the Digital Era and the realization of digital human rights, this article aims to analyze how human rights are manifested in the digital world and the need to apply them online.

Methodology: To achieve the expected result, the present study uses the deductive method and a descriptive, documentary, and bibliographic methodology.

Results: The article proposes a reflection on the concepts and expressions of globalization altered by new technologies, with a focus on the Internet and the reorganization of society around a digital world, to achieve the purpose of affirming that human rights must be respected, promoted and exercised by society in general.

Contributions: The research presents the analysis of the need for scientific understanding, in the current digital society, that human rights, enjoyed by people in the offline world, are also respected in the online world as a realization of human rights.
