O DIREITO FUNDAMENTAL À SAÚDE NA INTERSECÇÃO DA CRISE AMBIENTAL COM A PANDEMIA DA COVID-19

RESUMO

Objetivos: O artigo analisa a inter-relação da crise pandêmica da Covid-19 com a crise ambiental e oferece uma nova interpretação para o conceito de saúde no texto do art. 196, caput, da CR’88 com a consideração do equilíbrio ecológico previsto no art. 225, caput, da CR’88 e do conceito de One World, One Health para construção de uma norma de eco-saúde, que tutele não só os seres humanos, mas também os animais, as plantas e os ecossistemas.  

Metodologia: A pesquisa adota uma abordagem indutiva, a técnica de pesquisa é bibliográfica e documental, seu objetivo metodológico é exploratório e propositivo.

Resultados: O artigo propõe o seguinte conjunto de medidas, no âmbito jurídico, para mitigar os efeitos das Doenças Infecciosas Emergentes: o aprimoramento da interdisciplinaridade nas ciências jurídicas para compreensão do imbricamento da crise sanitária zoonótica da Covid-19 com a crise ambiental; a reflexão sobre a dimensão ontológica da crise ambiental para se superar a visão antropocêntrica e reducionista que nega valor intrínseco aos animais, plantas e ecossistemas;  a construção de uma nova interpretação para o conceito de saúde no texto do art. 196, caput, da CR’88 com a consideração do equilíbrio ecológico previsto no art. 225, caput, da CR’88 e do conceito de One World, One Health para construção de uma norma mais ampla e sistêmica, que abarque o conceito de  eco-saúde, mais apropriado ao enfrentamento e prevenção de zoonoses.

Contribuições: O estudo aborda um tema interdisciplinar e complexo que não tem sido amplamente pesquisado na ciência jurídica, bem assim apresenta uma proposta de interpretação do direito fundamental à saúde para a construção de uma norma jurídica mais ampla e sistêmica, com base no conceito de eco-saúde, portanto, mais adequada ao enfrentamento e prevenção das zoonoses epidêmicas, que emergem com a crise ambiental no Antropoceno.

ABSTRACT

Objectives: Thise paper analyzes the interrelation of the Covid-19 pandemic crisis with the environmental crisis and offers a new interpretation for the concept of health in the text of art. 196, caput, of CR'88 with consideration of the ecological balance provided for in art. 225, caput, of CR'88 and the concept of One World, One Health, for the construction of an eco-health standard, which protects not only humans, but also animals, plants and ecosystems.

Methodology: The research adopts an inductive approach, the research technique is bibliographic and documentary, its methodological objective is exploratory and propositional.

Results: Thise paper proposes the following set of measures, in the legal field, to mitigate the effects of Emerging Infectious Diseases: the improvement of interdisciplinary in the legal sciences to understand the overlap of the Covid-19 zoonotic health crisis with the environmental crisis; reflection on the ontological dimension of the environmental crisis in order to overcome the anthropocentric and reductionist view that denies intrinsic value to animals, plants and ecosystems; the construction of a new interpretation for the concept of health in the text of art. 196, caput, of CR'88 with consideration of the ecological balance provided for in art. 225, caput, of CR'88 and the concept of One World, One Health for the construction of a broader and more systemic standard, which encompasses the concept of eco-health, more appropriate for coping and preventing-zoonosis .

Contributions: The stud approachs an interdisciplinary and complex theme that has not been widely researched in legal science, as well as presenting a proposal for the interpretation of the fundamental right to health for the construction of a broader and systemic legal norm, based on the concept of eco-health. , and, therefore, more adequate to confront and prevent epidemic zoonosies, which emerge with the environmental crisis in the Anthropocene.
