A PRÁTICA DE ATOS PROCESSUAIS ELETRÔNICOS EM TEMPO DE PANDEMIA: PROTEÇÃO OU VIOLAÇÃO DOS DIREITOS HUMANOS PROCESSUAIS?

Resumo

ABSTRACT

Objective: The study proposes the examination of electronic procedural acts in Brazil during the pandemic state declared by the World Health Organization. To this end, it analyzes its practice, in accordance with the provisions in force, in light of the procedural human rights of the parties, which also have a fundamental feature, such as the right to a reasonable duration, to a hearing and to evidence, all derived from the right to a fair trial.

Methodology: The inductive method was used, and the technique is bibliographic research.

Results: The paper supports the existence of full possibility of practicing electronic procedural acts, in view of the applicable rules and the existing technology for that purpose. The performance of these acts must, however, take the aforementioned procedural rights into account, making them compatible, imposing the least possible restriction.

Contributions: The study addresses the practice of procedural acts in electronic form, used in profusion during pandemic times, from the perspective of their compatibility with procedural human rights.

RESUMO

Objetivos: O estudo propõe o exame dos atos processuais eletrônicos no Brasil durante o estado declarado de pandemia pela Organização Mundial da Saúde. Para tanto, observa a sua prática, de acordo com os dispositivos vigentes, à luz direitos humanos processuais das partes, que também possuem feição fundamental, como o direito à duração razoável, ao contraditório e à prova, todos derivados do direito ao processo justo.

Metodologia: Foi empregado o método indutivo e a técnica é a de pesquisa bibliográfica.

Resultados: O artigo defende a existência de plena possibilidade de prática de atos processuais eletrônicos, diante dos regramentos aplicáveis e da tecnologia existente para tanto. A realização desses atos deve, contudo, compatibilizar os direitos processuais mencionados, impondo a menor restrição possível.

Contribuições: O estudo aborda a prática dos atos processuais na forma eletrônica, utilizados em profusão em tempo de pandemia, sob a ótica de sua compatibilização com os direitos humanos processuais.
