ASPECTOS JURÍDICOS DAS "FAKE NEWS": REPERCUSSÕES NA ATUALIDADE

Objetivos: O presente estudo versa sobre a conceituação do que vem a ser Fake News e a sua implicação em nossa sociedade. A forma como as notícias falsas, as notícias falseadas, ou verdades manipuladas podem influenciar a vida de um povo, tanto juridicamente quanto socialmente.

Metodologia: A pesquisa foi realizada mediante uma abordagem indutiva, com análise de alguns casos mais relevantes, entendimento de conceitos jurídicos e uma pesquisa bibliográfica/documental, com objetivo exploratório e conclusivo.

Resultados: O estudo do assunto – Fake News, visa trazer uma luz, do ponto de vista jurídico, na atividade em si, explicando-a em suas diversas formas de ocorrência e apontando suas repercussões em nossa vida social.

Contribuições: Trata-se, obviamente, de assunto atual, e de grande relevância, mormente os impactos que estão ocorrendo em eleições, em disputas políticas de poder, construção e desconstrução de imagens e conceitos, alterando o pensar de toda uma população. A importância do tema, está relacionada ainda, de forma intrínseca com o exercício do poder e a manipulação de informações para obtenção de benefícios, lucros, e vantagens, nem sempre lícitas.

ABSTRACT

Objectives: The present study deals with the conceptualization of what Fake News is and its implication in our society. The way in which false news, falsified news, or manipulated truths can influence the lives of a people, both legally and socially.

Methodology: The research was carried out through an inductive approach, with analysis of some more relevant cases, understanding of legal concepts and a bibliographic / documentary research, with an exploratory and conclusive objective.

Results: The study of the subject - Fake News, aims to bring a light, from a legal point of view, on the activity itself, explaining it in its various forms of occurrence and pointing out its repercussions in our social life.

Contributions: Obviously, this is a current issue, and of great relevance, especially the impacts that are occurring in elections, in political power disputes, construction and deconstruction of images and concepts, changing the thinking of an entire population. The importance of the topic is also intrinsically related to the exercise of power and the manipulation of information to obtain benefits, profits, and advantages, which are not always competitive.
