A CRISE AMPLIADA PELA COVID 19 E OS FUNDAMENTOS JURÍDICOS DO DEVER HORIZONTAL DE SOLIDARIEDADE NO CONTEXTO CONTEMPORÂNEO BRASILEIRO

RESUMO

Objetivos: Compreender se o instituto jurídico da solidariedade pode ser utilizado como um dever constitucional que vincula as ações estatais e dos cidadãos, especialmente em tempos de crise, como a pandemia da COVID-19.

Metodologia: Por meio da revisão bibliográfica e análise de dados orçamentários públicos, buscou-se mostrar que a solidariedade pode ser utilizada juridicamente como um dever fundamental de forma vertical, mas também horizontal, ou seja, ela se constitui em um instrumento jurídico de aproximação das pessoas e resolução de problemas atuais, tal qual a pandemia causada pela COVID 19.  

Resultado: O dever fundamental de solidariedade horizontal é uma camada protetiva que pode auxiliar as esferas públicas e privadas, neste momento de crise.

Contribuições: O estudo indica que o desdobramento vertical do dever de solidariedade se refere à relação entre o Estado e os particulares, e a dimensão horizontal refere-se às relações entre os particulares, ou seja, os cidadãos agindo em prol do seu próximo. Demonstrou-se que o dever de solidariedade horizontal pode ser mais uma dimensão de proteção para as pessoas neste momento em que há uma singular crise, que dificultou a atuação dos agentes públicos e, também, dos privados.

ABSTRACT

Objectives: Understanding whether the legal institute of solidarity can be used as a constitutional duty that binds the State and citizen actions, especially in times of crisis, such as the COVID-19 pandemic.

Methodology: Through bibliographic review and analysis of public budget data, we sought to show that solidarity can be used legally as a fundamental duty in a vertical  and also horizontal, that is, it constitutes a legal instrument for bringing people together and solving current problems, such as the pandemic caused by COVID 19.

Result: The fundamental duty of horizontal solidarity is a protective layer that can help public and private spheres in this moment of crisis.

Contributions: The study indicates that the vertical corollary of the duty of solidarity refers to the relationship between the State and individuals, and the horizontal dimension refers to relationships between individuals, that is, citizens acting on behalf of their neighbors. It has been shown that the duty of horizontal solidarity can be another dimension of protection for people at a time when there is a singular crisis, which has hampered the performance of public agents and also private ones.
