ESTUDO DA RELAÇÃO COMPLEXIDADE AMBIENTAL, ÉTICA E DIREITO ATRAVÉS DE ANÁLISE DO PROJETO DE TRANSPOSIÇÃO DO RIO SÃO FRANCISCO (BRASIL)

RESUMO

Objetivo: Analisar a relação entre meio ambiente natural, pensamento complexo e direito na racionalidade jurídica moderna, interessam ao objeto de estudo do presente trabalho, sob o aspecto da relação meio ambiente, sociedade e direito, à luz do pensamento complexo, cuja necessidade de aplicação no processo de gestão dos recursos ambientais visa atingir o objetivo da sustentabilidade.

Metodologia: Utilizou-se o método dedutivo, com análise documental, da legislação e jurisprudência.

Resultados: Perceber a relação sistêmica do meio ambiente com outras searas do saber está presente em nossas vidas, de forma que a percepção da complexidade das intervenções na natureza e das causas de desequilíbrios no tecido social em diversas dimensões, passa a integrar a pesquisa científica em múltiplas dimensões. Verifica-se uma dificuldade concreta na realização da sustentabilidade sem que a ética ambiental seja posta na pauta enquanto intrínseca à denominada sustentabilidade. A problemática ambiental sustentável é ética, antes de ser uma questão econômica, política, social e cultural. Então é necessário trabalhar o desenvolvimento econômico sustentável e a complexidade ambiental em bases éticas, fundados na alteridade, no Outro.

Contribuições: Ajudar aperceber que o problema não é, portanto, de espaço legal, mas de como estabelecer condições práticas para a existência do previsto na Constituição Federal. Tais condições, que se denominam de condições práticas, passariam pelo estabelecimento de uma leitura sistêmica, por meio da abordagem do pensamento complexo, da Constituição Brasileira e de um diálogo de saberes que envolvesse o Direito, a Sociologia, a Filosofia, a História, a Educação e, de forma necessária, a ética na busca do entendimento das problemáticas ambientais.

ABSTRACT

Objective: To analyze the relationship between natural environment, complex thinking and law in modern legal rationality, the object of study of this work is of interest, under the aspect of the relationship between environment, society and law, in the light of complex thinking, whose need for application in the process of managing environmental resources, it aims to achieve the goal of sustainability.

Methodology: The deductive method was used, with documentary analysis, of the legislation and jurisprudence.

Results: Realizing the systemic relationship of the environment with other fields of knowledge is present in our lives, so that the perception of the complexity of interventions in nature and the causes of imbalances in the social fabric in several dimensions, starts to integrate scientific research in multiple dimensions. There is a concrete difficulty in achieving sustainability without environmental ethics being placed on the agenda as intrinsic to the so-called sustainability. The sustainable environmental issue is ethical, before being an economic, political, social and cultural issue. So it is necessary to work on sustainable economic development and environmental complexity on ethical grounds, based on alterity, on the Other.

Contributions: Helping to realize that the problem is not, therefore, of legal space, but of how to establish practical conditions for the existence of what is foreseen in the Federal Constitution. Such conditions, which are called practical conditions, would involve the establishment of a systemic reading, through the approach of complex thinking, the Brazilian Constitution and a dialogue of knowledge involving Law, Sociology, Philosophy, History, Education and, in a necessary way, ethics in the search for understanding environmental issues.
