A RELEVÂNCIA DOS ASPECTOS JURÍDICO-LEGAIS EM GESTÃO DE PROJETOS: UM MAPEAMENTO DA LITERATURA

RESUMO

Objetivo: As pesquisas sobre gestão de projetos têm avançado significativamente em seus aspectos procedimentais e comportamentais, tais como pesquisas sobre gestão de stakeholders, gestão de risco, Recursos Humanos, entre outras. No entanto, observa-se que ainda há um gap com relação a estudos relacionados aos aspectos jurídico-legais em gestão de projetos. Temas como gestão de contratos, relações e acordos internacionais, segurança de dados, aspectos trabalhistas em projetos globais etc., são ainda pouco evidenciados em periódicos científicos relevantes para o campo dos estudos de gestão de projetos.

Metodologia: A pesquisa realizada pode ser caracterizada como exploratória com abordagem qualitativa. A estratégia metodológica adotada foi Revisão Sistemática da Literatura (RSL), a fim de compreender a convergência de duas temáticas relevantes.

Resultados: Os resultados indicam a categorização dos conteúdos dos artigos de acordo com a classificação em cinco categorias: (a) Contrato; (b) Fatores Críticos; (c) Legislação de Software; (d) Recursos Humanos; (e) Requerimentos Legais. Ao final se sugere um conjunto de estudos futuros com base nos resultados.

Contribuições: A primeira temática está relacionada aos aspectos jurídico-legais e a segunda gestão de projetos. Os artigos selecionados na base de dados Web of Science foram triados e o corpus de análise foi constituído por 61 artigos publicados entre os anos de 1991 e 2020. Os periódicos que constituíram o corpus de análise estavam distribuídos por diversos campos de estudos como gestão, engenharia, tecnologia, entre outros.

ABSTRACT

Objective: Research on project management has advanced in its procedural and behavioral aspects, such as research on stakeholder management, risk management, Human Resources, among others.  However, it is observed that there is still a gap concerning studies related to legal aspects in project management. Themes such as contract management, international agreements, and relationship, data security, labor aspects in global projects, among others, are still scarce evidenced in scientific journals relevant to the field of project management studies.  In this sense, this work aims to analyze how the studies on project management deal with legal aspects.

Methodology: The research carried out can be characterized as exploratory with a qualitative approach. The methodological strategy adopted was a Systematic Literature Review (RSL), intending to understand the convergence of two relevant themes.

Results: The results indicate a categorization of the content of the articles according to a classification in five categories: (a) Contract; (b) Critical Factors; (c) Software Legislation; (d) Human Resources; (e) Legal Requirements. In the end, if necessary, a set of future studies based on the results.

Contributions: The first theme is related to legal aspects and the second theme is project management. The articles selected in the Web of Science database were screened and the corpus of analysis consisted of 61 articles published between the years 1991 and 2020. The journals that constituted the corpus of analyzes were distributed in several fields of studies such as management, engineering, technology, among others.
