O ESTADO CONSUMIDOR E A UTILIZAÇÃO DA ENERGIA SOLAR NAS EDIFICAÇÕES PÚBLICAS: UMA ANÁLISE A PARTIR DO PARADIGMA DA SUSTENTABILIDADE

RESUMO

Objetivo: O estudo tem por objetivo discutir a ideia de sustentabilidade na Administração Pública, com base na utilização de energia elétrica fotovoltaica nas edificações públicas.

Metodologia: O método utilizado é o dedutivo e monográfico e a técnica de pesquisa bibliográfica, com análise da legislação relacionada e da doutrina sobre o tema.

Resultados: Entende-se que a utilização dos sistemas fotovoltaicos nas edificações públicas constitui a materialização de práticas sustentáveis, o que deve ser plenamente incentivado e implementado na maior medida possível.

Contribuições: A análise parte da contextualização da energia elétrica produzida por irradiação solar no Brasil, seus marcos regulatórios e explicações técnicas, para depois passar a analisar a importância do Estado consumidor, para além das suas funções tradicionais, passando a atuar como importante ator e fomentador da economia no setor, bem como sua responsabilidade na tomada de decisões mais sustentáveis. Neste ponto, observa-se a existência de um novo paradigma no Direito Administrativo, a exemplo da lei de licitações que passou a prever expressamente o critério da sustentabilidade, e de leis e projetos de lei para implementação da energia solar fotovoltaicas nas edificações públicas.

ABSTRACT

Objective: The purpose of this review is to discuss the idea of sustainability in the Public Administration based on the photovoltaic solar power in public buildings.

Methodology: The method and technique used are, respectively, the deductive and monographic, and the bibliographic research, with the analysis of related legislation and the doctrine about the subject.

Results: It is understood that the use of photovoltaic power systems in public buildings means the materialization of the sustainable practices, which shall be encouraged and implemented the most.

Contributions: The analysis starts from the contextualization of the power generated by the solar radiation in Brazil, the important regulations passed and the technical explanations. After that, it is observed the importance of the consumer Government beyond of its traditional functions, and the importance of its responsibility to take more sustainable decisions. At this point, it is observed the existence of a new paradigm in the Administrative Law, as it is seen in the public bids law which now requires the sustainability criterion in the process of decision making. It is also observed new laws and projects of laws that aims the implementation of photovoltaic power in public buildings.
