RELAÇÕES ENTRE ECONOMIA E DIREITO NA PERSPECTIVA DO NOVO ESTRUTURALISMO JURÍDICO

Objetivo: analisar a problemática da relação entre Economia e Direito segundo a matriz teórica do Novo Estruturalismo Jurídico de Calixto Salomão Filho.

Metodologia: pesquisa de perfil exploratório, baseada em linha de raciocínio dedutivo e nas técnicas de revisão bibliográfica e documental.

Resultados:pôde-se perceber, a partir da revisão bibliográfica e documental: i) a existência de um quadro geral de ampliação de argumentos em prol da defesa da necessidade de aprofundamento de uma visão liberal dos mercados; ii) que a difusão e a aceitação de tais ideias, no Brasil, influenciaram medidas concretas como as reformas da previdência e das leis trabalhistas, assim como a Lei da Liberdade Econômica; iii) esse quadro/cenário reserva ao Direito um papel específico na problemática de sua relação com a Economia, na condição de instrumento para a perseguição de fins econômicos. 

Contribuições: apresentar o Novo Estruturalismo Jurídico como alternativa para subsidiar reflexões sobre a problemática da relação entre Economia e Direito. Oferecer, a partir desta matriz teórica, uma proposta de ideia-força a respeito do papel do Direito na problemática da sua relação com a Economia.

ABSTRACT

Objetive: to analyze the problem of the relationship between Economics and Law according to the theoretical approach of the New Legal Structuralism by Calixto Salomão Filho.

Methodology: exploratory profile research, based on deductive reasoning and bibliographic and documentary review techniques.

Results: it was possible to perceive, from the bibliographic and documental review: i) the existence of a general framework for expanding arguments in favor of defending the need to deepen a liberal view of the markets; ii) that the diffusion and acceptance of such ideas, in Brazil, influenced concrete measures such as pension and labor law reforms, as the Economic Freedom Act; iii) this framework/scenario reserves to the Law a specific role in the problem of its relationship with the Economy, as an instrument for the pursuit of economic goals.

Contributions: to present the New Legal Structuralism as an alternative to support reflections on the problematic of the relationship between Economy and Law. To offer, based on this theoretical approach, a proposal of an idea-force regarding the role of Law in the problem of its relationship with Economy.
