A TUTELA JURÍDICA MATERIAL E PROCESSUAL DA SENCIÊNCIA ANIMAL NO ORDENAMENTO JURÍDICO BRASILEIRO: ANÁLISE DA LEGISLAÇÃO E DE DECISÕES JUDICIAIS

RESUMO

A Constituição Federal de 1988, ao prever expressamente acerca da proteção da fauna e a vedar a crueldade contra esses seres, passou a reconhecer que a tutela animal possui um fim em si mesma, e não apenas justificada na tutela genericamente ambiental. Não obstante, o ordenamento jurídico brasileiro optou por conferir aos animais a natureza jurídica de “coisa”, resultando em uma contradição a ser reparada pela doutrina e jurisprudência brasileiras, as quais, ainda que vagarosamente, vêm estendendo o comando constitucional para fazer constar de sua interpretação que os animais são seres sencientes. Sendo assim, reconhece-se que o viés exclusivamente antropocêntrico em relação à fauna não pode prosperar, o que se observa até mesmo das tendências legislativas acerca do tema.

ABSTRACT

The brazilian Federal Constitution of 1988, expressly foreseeing the protection of fauna and prohibiting cruelty to these beings, came to recognize that animal protection has an end in itself, and it's not only justified in the protection of the environment as a whole theme. Nevertheless, the Brazilian legal system has chosen to confer on animals the legal nature of "thing", resulting in a contradiction to be repaired by Brazilian doctrine and jurisprudence, which, although slowly, extends the constitutional command to include in its interpretation that animals are sentient beings. Thus, it is recognized that the exclusively anthropocentric bias towards fauna can not continue, which can be observed even from the legislative tendencies on the subject.
