DAS EINGREIFEN DES STAATES, „MEDIOKRATIE“ UND DIE BRASILIANISCHE REALITÄT IN ARBEITSBEZIEHUNGEN: KURZE ERWÄGUNGEN

Resumo

ZUSAMMENFASSUNG

Der Zweck dieses Artikels besteht darin, die Arbeitsbeziehungen in Brasilien zu untersuchen und die Rolle des Staates bei der Suche nach Mindestgarantien für die Würde der Arbeitnehmer zu garantieren. Zu diesem Thema wird das Thema der nationalen Mediokratie unter dem Gesichtspunkt der Mittelmäßigkeit von Politikern, Herrscher und Beamter im Allgemeinen und ihrer kleinlichen und unehrlichen Haltung diskutiert. Das Thema wird auch in einer historischen Herangehensweise behandelt, vom Absoluten Staat über den Liberalen Staat und seinen Übergang zum Sozialstaat, speziell in Brasilien, ab 1934, wo die staatliche Intervention hauptsächlich dazu benutzt wird, um ihr Leben zu verbessen mit der Unterstutzing in Politik und Beamter Karriere. Die Arbeit wurde durch bibliografische Forschung und Interpretation von Rechtstexten entwickelt, wobei auch eine historische Perspektive gesucht wurde, die zu der Schlussfolgerung führte, staatliche Eingriffe müssen genutzt werden, um das Staat zu stärken und seinen Bürgern durch das Verschwinden des Privilegs für wenige Menschen und den Aufbau einer echten Demokratie zu helfen.

ABSTRACT

The purpose of this article is to investigate labor relations in Brazil and the role of the State in seeking to guarantee workers minimum rights to assure their dignity. For this, the topic of national mediocracy is discussed on the prism of the mediocrity of politicians, governors and public officials in general and their petty and dishonest attitudes. The subject is also treated in a historical approach, from the Absolute State through the Liberal State and its transition to the Social State, specifically in Brazil, from 1934, where the state intervention is used mainly to rise one’s life sustained in politics and public careers. The research was developed through bibliographic research and interpretation of legal texts, also seeking a historical perspective, which allowed to conclude that state intervention should be used to enhance the country and benefit its citizens, with the disappearance of the privilege for few people and building a true democracy.

RESUMO

O presente artigo tem por objetivo pesquisar as relações do trabalho no Brasil, e o papel do Estado ao buscar assegurar aos trabalhadores direitos mínimos para lhes garantir dignidade. Para tanto, discute-se o tema da mediocracia nacional sobre o prisma da mediocridade dos políticos, goverrnantes e funcionalismo público em geral e suas atitudes mesquinhas e desonestas. O assunto também é tratado em abordagem histórica, a partir do Estado Absoluto, passando pelo Estado Liberal e sua transição para o Estado Social, especificamente no Brasil, a partir de 1934, onde a intevenção estatal é utilizada mormente para subir na vida às custas da política e carreiras públicas. A pesquisa foi desenvolvida através de pesquisa bibliográfica e interpretação de textos jurídicos, buscando também uma perspectiva histórica, o que permitiu concluir que, a intervenção estatal deve ser utilizada para engrandecer a pátria e beneficiar seus cidadãos, com o desaparecimento do privilégio para poucas pessoas e construção de uma verdadeira democracia.
