O ACESSO UNIVERSAL E SUSTENTÁVEL AO DIREITO AO SANEAMENTO COMO CAMINHO DE CONSTRUÇÃO DO DESENVOLVIMENTO

RESUMO

O direito fundamental de acesso ao saneamento básico reconhecido pela Constituição Federal de 1988, revela a constitucionalização do poder-dever de repartição de competências administrativas dos entes federados para fins de desenvolvimento sustentável. No âmbito federal, a lei n. 11.445/2007 traça diretrizes que evidencia a interligação de saneamento e meio ambiente. Neste sentido, há uma necessidade de conciliação para o desenvolvimento com a sustentabilidade em prol de garantir a redução das desigualdades sociais, com a implantação de estruturas de saneamento nos domicílios, e, por conseguinte, a busca ao direito à saúde como direito social fundamental.

ABSTRACT

The fundamental right of access to basic sanitation recognized by the Federal Constitution of 1988 reveals the constitutionalisation of the power-duty of distribution of administrative powers of the federated entities for the purposes of sustainable development. In the federal scope the law n. 11.445 / 2007 outlines guidelines for the interconnection of sanitation and the environment. In this sense, there is a need for reconciliation for development with sustainability in order to guarantee the reduction of social inequalities, with the implementation of sanitation structures in the homes, and, consequently, the search for the right to health as a fundamental social right.
