APONTAMENTOS SOBRE O PROCESSO LEGAL DE ADOÇÃO INTERNACIONAL: UMA EXEGESE POSSÍVEL

Na observação dos grandes problemas sociais do mundo contemporâneo, especialmente os enfrentados diuturnamente nas estruturas comunitárias modernas, se percebe um dos maiores “males do século”, que contempla um exorbitante número de crianças e adolescentes abandonados pelos pais biológicos (pelos mais diferentes motivos) e que procuram, incessantemente, novos lares e/ou famílias adotivas que tenham por finalidade abrigá-los para proteção jurídica e exercício do direito fundamental à família e educação. Não há dúvida de que o instituto da adoção é um dos temas mais polêmicos e instigantes que se localiza em órbita jurídica, especialmente quando elevado a status internacional, onde se encontram “choques culturais” – por conta das mais diversas formas sociais e de costumes – entre o adotante e o adotando. É a partir desta realidade que o presente artigo tem como finalidade a análise da referida realidade, tendo como metodologia de observação o caminho do real para o abstrato culminando na análise crítica do conteúdo mencionado.

ABSTRACT

In observing the great social problems of the contemporary world, especially those faced day by day in modern community structures, one can perceive one of the greatest "evils of the century", which contemplates an exorbitant number of children and adolescents abandoned by their biological parents (for different reasons) and Who incessantly seek new homes and / or adoptive families whose purpose is to shelter them for legal protection and exercise of the fundamental right to family and education. There is no doubt that the institute of adoption is one of the most controversial and provocative subjects that is located in legal orbit, especially when raised to international status, where are "cultural shocks" - due to the most diverse social forms and customs - Between the parties to the adoption process. It is from this reality that the present article aims at the analysis of reality, having as observation methodology the path from the real to the abstract culminating in the critical analysis of the content mentioned.
