O CONTRADITÓRIO PRÉVIO E A MOTIVAÇÃO NO JUÍZO DE ADMISSIBILIDADE DA ACUSAÇÃO: O RECONHECIMENTO COMO UM FUNDAMENTO FILOSÓFICO-POLÍTICO

O juízo de admissibilidade da acusação, como estabelecido atualmente na legislação brasileira, não contempla o contraditório prévio e a exigência de fundamentação. Isto implica a inconstitucionalidade da decisão relativa à ação penal, fato que representa severa afronta à esfera de direitos constitucionais do acusado. Aqui, os direitos à motivação (CR, art. 93, IX) do juízo de admissibilidade da acusação e ao seu contraditório prévio recebem da teoria do reconhecimento de Axel HONNETH um possível fundamento filosófico-político, como a expressão de uma luta social (virtual) protagonizada pelos cidadãos socialmente excluídos, que estão fadados a ser o alvo principal do sistema penal.

ABSTRACT

The admissibility of the accusation, as currently provided by the Brazilian law does not establish the previous right to be heard and does not require the decision reasoning. This implies the unconstitutionality of this decision concerning the criminal action, what causes severe damage to the sphere of constitutional rights of the accused. Here, the rights to the decision reasoning (Brazilian Constitution, art. 93, IX) and the right to be heard before the admissibility of the accusation receive from the theory of recognition (Axel Honneth) a possible philosophical-political basis, as the expression of a social struggle starred by the socially excluded people, which are bound to be the main target of the criminal justice system.
