DIREITOS E GARANTIAS FUNDAMENTAIS E A CONSOLIDAÇÃO DOS DIREITOS SOCIAIS DOS TRABALHADORES NO ESTADO CONTEMPORÂNEO

RESUMO

Os direitos e garantias fundamentais representam conquistas do homem para alcançar a liberdade em relação ao Estado. Nos direitos sociais, incluem-se os direitos à vida em sociedade, econômicos e culturais. Os direitos dos trabalhadores incluem-se nessa espécie, e são frutos da luta travada pelos trabalhadores na transformação do Estado de Direito Liberal em Estado Social de Direito, onde estes alcançaram várias conquistas. Dentro de um viés reflexiológico, em que se busca o entendimento dos direitos e garantias fundamentais e direitos sociais dos trabalhadores em consonância com as relações de trabalho, principalmente no momento contemporâneo, a pesquisa, essencialmente bibliográfica, leva à busca pela investigação do quão utopicamente esses direitos se consolidam na prática, principalmente quando se observa que os mesmos não se estendem a toda a categoria de indivíduos inseridos no contexto da economia informal, ou daqueles que se encontram à margem do mercado de trabalho.

RESUME

The rights and guarantees represent man's achievements to attain freedom from the state. The social rights include the rights to life in society, economy and culture. Workers' rights include this species, and the fruit of the struggle of workers in the transformation of Liberal rule of law in social state of law, where they reached several achievements. Within a reflexiológico bias, which seeks the understanding of fundamental rights and guarantees and social rights of workers in line with labor relations, especially in the contemporary moment, research, primarily literature, leads to the pursuit of research on how idealistically these rights are consolidated in practice, especially when it is observed that they do not extend to the entire category of individuals within the context of the informal economy, or those who are outside the labor market.
