SUPREMACIA DA CONSTITUIÇÃO NA HERMENÊUTICA CONSTITUCIONAL À LUZ DOS ENSINAMENTOS DE KONRAD HESSE E FERDINAND LASALLE E AS TEORIAS DE CONTROLE DE CONSTITUCIONALIDADE

Abstract

RESUMO

Esta pesquisa teve o objetivo de analisar a força normativa da Constituição à luz dos ensinamentos dispostos nas obras literárias jurídicas de Hesse e Lassalle, bem como estudar a origem e a aplicabilidade das teorias de constitucionalidade (judicial review) no ordenamento jurídico brasileiro, a fim de verificar as contribuições para o ordenamento jurídico brasileiro. O método utilizado na pesquisa foi o método dedutivo, sendo que, quanto aos meios a pesquisa foi bibliográfica com consulta à legislação doutrina e jurisprudência e, quanto aos fins a pesquisa foi qualitativa. A conclusão a que se chegou foi de que a interpretação da Constituição com viés sociológico ou essencialista baseada nos fatores reais do poder defendido por Lassalle complementa a interpretação da Constituição com viés normativo determinado pela ordem fundamental jurídica da coletividade suscitado por Hesse, desta forma as posições dos autores se retroalimentam e as teorias de controle de constitucionalidade se revelam como instrumentos para tutelar os direitos humanos fundamentais.

ABSTRACT

This research aimed to analyze the normative force of the Constitution in the light of the teachings provided in the legal literary works of Hesse and Lassalle, as well as to study the origin and applicability of constitutional theories (judicial review) in the Brazilian legal system, in order to verify the contributions to the Brazilian legal system. The method used in the research was the deductive method, and as for the means, the research was bibliographic with reference to legal doctrine and jurisprudence, and for the purposes, the research was qualitative. The conclusion reached was that the interpretation of the Constitution with a sociological or essentialist bias based on the real factors of power defended by Lassalle complements the interpretation of the Constitution with a normative bias determined by the fundamental legal order of the community raised by Hesse, thus the positions of the authors feed back and constitutionality control theories are revealed as instruments to protect fundamental human rights.
