A APLICAÇÃO DO PRINCÍPIO DA INSIGNIFICÂNCIA COMO FORMA DE EFETIVAÇÃO À DIGNIDADE DO RÉU

A partir de um estudo bibliográfico e dedutivo, o presente artigo se propõe a investigar em que medida o princípio da insignificância atua como forma de efetivação da dignidade do réu. Tendo em vista a relevância do tema no âmbito doutrinário e jurisprudencial, traçar uma análise da atuação do princípio da insignificância e da bagatela como forma de afastar a tipicidade penal das condutas. Incialmente, buscar seu conceito, origem e evolução histórica do princípio da insignificância, seguindo com os seus fundamentos e uma análise deste princípio como forma de afastar a tipicidade penal das condutas e a posição dos Tribunais Superiores sobre a aplicação desse princípio. Trazendo sempre a concepção de estudiosos sobre o tema que esboça este trabalho, assim como também se faz importante traçar os critérios de reconhecimento da conduta penalmente insignificante e, ao final responder a problemática levantada inicialmente no intuito de despertar uma visão crítica ao leitor a respeito do tema.

ABSTRACT

From a bibliographical and deductive study, this paper aims to determine to what extent the principle of insignificant acts as a protection to persons. Given the relevance of the theme in the doctrinal and jurisprudential framework, draw an analysis of its performance from the principle of insignificance and trifle as a means of warding off the criminal typicity of pipelines. First, to look for their concept, origin and evolution of the Brazilian judicial system, according to the position of the superior courts on the application of this principle. Bring the design of some authors on the subject describing this work, and it is also important to follow the criteria for recognizing criminal conduct, and ultimately to answer the questions raised initially in order to raise a critical eye on the reader's theme.
