Este artigo pretende analisar a validade da cobrança, mediante abordagem tópico-indutiva, ao considerar como ponto de partida a contemporânea divergência jurisprudencial a respeito, e sistemático-dedutiva, ao estabelecer os conceitos de dever de informação, de onerosidade excessiva, de cláusula abusiva e de venda casada para, em seguida, aferir se há subsunção da cobrança do adquirente às normas pertinentes.

ABSTRACT

This article intends to analyze the validity of the collection, using a topic-inductive approach, considering as a starting point the contemporary jurisprudential divergence in respect, and systematic-deductive, in establishing the concepts of duty of information, excessive onerousness, abusive clause and Marketed to determine whether the buyer is subject to the relevant rules.
