CONSTRUÇÃO E APLICAÇÃO DO DIREITO: ANÁLISE DA SÚMULA VINCULANTE Nº 33

RESUMO

No intuito concretizar a norma de eficácia e aplicabilidade limitada, que versa sobre a aposentadoria especial prevista no § 4º, do art. 40, da CF/88, foi editada a Súmula Vinculante nº 33, que assegura a aplicação das regras do regime geral da previdência (RGPS)  ao servidor público (RPPS), quando cabível, ou seja, quando inexistir a lei complementar dispondo sobre a aposentadoria especial para o respectivo servidor público. Mas, esta súmula deveria prever as hipóteses necessárias para assegurar que seja aplicada ao mesmo fato que lhe deu origem. Assim, o objetivo desta pesquisa é buscar, na cultura da “common law”, critérios da “ratio decidendi” que gerem maior confiabilidade na aplicação da referida súmula, além de propor uma nova redação. A metodologia utilizada será de caráter dedutivo a partir de pesquisa doutrinária e jurisprudencial, inclusive originária da cultura da “common law”. É esperado chamar atenção dos operadores do direito para a importância do debate sobre a necessidade de estabelecer critérios objetivos para a aplicação da Súmula Vinculante nº 33.

ABSTRACT

In order to achieve the standard of effectiveness and limited applicability, which deals with the special retirement provided for in § 4 of art. 40, of CF / 88, was issued Binding Precedent nº 33, ensuring the application of the rules of the general social security system (RGPS) to the public server (RPPS), when appropriate, in other words, when the non-existence complementary law providing for the special retirement for the respective public servant. However, this Precedent should provide the assumptions necessary to ensure that it be applied to the same facts that gave rise to it. The objective of this research is to look at the culture of "common law" criteria of the "ratio decidendi" that generate greater reliability in the application of that precedent, and propose a new wording. In view of this, will be used doctrinal and jurisprudential research, including original culture of "common law". Thus, it is expected to draw attention of law professionals of the importance of the debate on the need to establish objective criteria for the implementation of Binding Precedent nº 33.
