A MÍDIA COMO PODER SELVAGEM E A DEMOCRACIA ENCLAUSURADA

O presente artigo busca abordar a (inter)relação da mídia, doravante conceituada como meios de comunicação, e a democracia, cogitando, ainda, da opinião pública como instrumento de controle social sobre o governo. Para tanto, o debate se apresenta na esfera dos direitos comunicativos, que se consagram como relativos a quaisquer formas de expressão ou de recebimento de informações, e ainda, sob a luz da tese habermasiana de direitos fundamentais à participação como processo legítimo das instituições estatais e do próprio direito. Enfrentando a problemática da interferência da mídia no papel da democracia, faz-se necessário, para tanto, uma análise da legislação, ou a sua falta, sobre os liames de atuação dos meios comunicativos no quadro contemporâneo. Para tanto, será utilizado o método de pesquisa dedutivo, através da técnica de pesquisa bibliográfica e documental.

ABSTRACT

This article seeks to address the (inter) media relationship, now defined as the media and democracy, considering also the public as instrument of social control over the government. Therefore , the debate is presented in the sphere of communicative rights, which are devoted to relate to all forms of expression or receiving information , and also in the light of Habermas's theory of fundamental rights to participation as a legitimate process of state institutions and own right . Facing the media interference problem in the role of democracy, it is also necessary to an analysis of the legislation, or lack thereof, on the bonds of action of the communication media in the contemporary context. To reach the goal, it will use the method of deductive research, through the bibliographical and documentary research technique.
