DIREITO AO MEIO AMBIENTE E O NECESSÁRIO CONTROLE DA POLUIÇÃO ATMOSFÉRICA: A INOVAÇÃO TRAZIDA PELO ESTADO DO ESPÍRITO SANTO

O presente artigo trata da necessidade de controle e monitoramento ambiental contínuo das fontes de poluição atmosférica. A relevância do tema é notória quando direcionada à saúde humana e à qualidade de vida, razão pela qual, pretende-se analisar a obrigatoriedade e a importância do monitoramento ambiental de fontes de poluição atmosférica. Para tanto, abordar-se-á a previsão constitucional, para posteriormente, ingressar na normatização infraconstitucional. Serão ainda analisados os princípios do meio ambiente que devem ser observados quando em questão o direito ao meio ambiente e o necessário controle da poluição atmosférica. Assim, procura-se estimular a sustentabilidade ambiental, estudos e novas tecnologias que podem ser adotadas pelo órgão ambiental no monitoramento da qualidade ambiental, bem como, evitar atos de poluição ambiental e resguardar o direito ao meio ambiente não poluído.

ABSTRACT

This present article considers the needy of control and continuous environmental monitoring of air pollution sources. The relevance of the subject, which involves environmental monitoring of atmospheric emissions, is notorious when related to human health and quality of life, which is why we intend to analyze the requirement and importance of environmental monitoring of air pollution sources. In this way, will be consider the constitutional provision, to subsequently join the infra constitutional law. It will be further analyzed the principles of the environment that must be observed when in question the right to the environment and the need to control the air pollution. Therefore, pretend to encourage environmental sustainability, studies and new technologies that can be adopted by the environmental agency in monitoring the environmental quality, such as well, avoid acts of environmental pollution and protect the right to an unpolluted environment.
