Este artigo trata do avanço das nanotecnologias incidente sobre a vida das pessoas com necessidades especiais, compreendidos nesta categoria os sujeitos com deficiência e os idosos. Neste contexto, explora a existência de microssistemas jurídicos de proteção e a necessidade de efetivação do direito (dever) constitucional de inclusão por meio desses sistemas. Promovida por meio de revisão bibliográfica, a investigação revelou que o notável impacto das nanotecnologias, especialmente em favor da qualidade de vida das pessoas com necessidades especiais, é desafiado pelas incertezas sobre potenciais riscos tecnológicos, bem como por processos de exclusão engendrados a partir de distorções do sistema capitalista. Assim, evidencia-se o necessário fortalecimento da participação direta da sociedade na tomada de decisões e o diálogo entre as fontes jurídicas como fatores regentes para a construção de uma ética dos direitos humanos.

ABSTRACT

This article deals with the advancement of nanotechnologies incident on the lives of people with special needs, included in this category the subjects with disabilities and the elderly. In this context, it explores the existence of legal micro-systems of protection and the need to implement the constitutional right (duty) of inclusion through these systems. Promoted through a literature review, research has shown that the remarkable impact of nanotechnologies, especially for the quality of life of people with special needs, is challenged by uncertainties about potential technological risks as well as exclusionary processes engendered by distortions of the capitalist system. Thus, the necessary strengthening of the direct participation of society in decision-making and the dialogue among legal sources as regent factors for the construction of an ethics of human rights is evident.
