Resumo

RESUMO

O direito de arena é um instituto jurídico específico para atividades esportivas, objeto de interesses do direito do trabalho e do direito desportivo. É também assegurado pelo direito civil, mais especificamente do direito da personalidade, haja vista ser um reflexo patrimonial do direito à imagem coletiva. O trabalho apresentado tem por fim estudar o direito de arena através da análise da relação jurídica existente entre os envolvidos, da sua origem, da contextualização na história no direito brasileiro, da natureza jurídica apontando os titulares do direito, a forma de arrecadação e destinação do valor arrecadado em razão de seu exercício, sua disposição e algumas questões polêmicas.

ABSTRACT

The arena right is a specific legal institute for sportive activities, being therefore subject of labor and sportive Law. It is also assured by civil Law, especially in connection to personality rights, considering the patrimonial effects into the collective image rights. The present paper has the objective to study the arena rights thru the analysis of the legal relations between the involved parties; the origin of the arena rights, its historical contextualization in the Brazilian Law, the legal nature defining the holder rights, the ways of collection and the destination of the value raised concerning its exercise and disposal, as well as some polemical matters.
