OS DESAFIOS E PERSPECTIVAS DO ESTADO NO CUMPRIMENTO DO DEVER DE PRESTAÇÃO DE SERVIÇOS DE SAÚDE

RESUMO

A presente pesquisa tem por objetivo analisar a Responsabilidade Civil do ente Estatal quanto à prestação dos serviços de saúde pública, sendo esta um dever, bem como um direito constitucional e fundamental de todo o cidadão, cabe analisar a responsabilidade estatal sobre premissa de um Estado Democrático de Direito, o qual toma para si o dever de cuidado da coletividade, garantindo a continuidade de um Estado Social, voltado ao cidadão e ao seu bem estar. Quando ocorre a falta na garantia da preservação, manutenção e promoção da saúde pública surge então à responsabilização do Estado por tal descumprimento do dever constitucional.

ABSTRACT

This research aims to analyze the Liability of the State entity for the provision of public health services, which is a duty as well as a fundamental and constitutional right of every citizen, we need to analyze the state responsibility on the premise of a democratic state of law, which takes upon itself the duty of care of the community, ensuring continuity of a welfare state, the citizen and returned to your well being. When there is a lack in ensuring the preservation, maintenance and promotion of public health arises then the accountability of the State for such breach of constitutional duty.
