RESUMO

Este ensaio é um trabalho de historicismo jurídico. Ele visa a discutir, em uma perspectiva evolutiva, os diferentes sistemas de Direito vigentes ao longo da História inglesa. Os seres humanos, enquanto vivem entre seus iguais, precisam de sistemas legais qualificados para harmonizar as relações sociais que vivenciam. Nesses termos, os sistemas jurídicos são elementos fundacionais nas sociedades civilizadas. Entretanto, nas sociedades modernas somente sistemas constitucionalistas sob a égide do Estado de Direito e comprometidos com os direitos civis, individuais e fundamentais são capazes de garantir um Estado voltado ao bem-estar social. Neste texto, será examinada, através desse longo caminho histórico, a formação do sistema jurídico inglês e a sua consolidação como um sistema constitucionalista de Direito.

ABSTRACT

This essay is a work of historic jurisprudence. It aims to discuss, in an evolutionary perspective, the different applicable systems of laws along the English history. Human beings, while living among equals, need qualified systems of Law to harmonize their social relations. In such terms, legal systems are foundational elements of the civilized societies. Nevertheless, for modern societies, only constitutional legal systems under the rule of Law, in respect to civil, individual and fundamental rights are able to guarantee a welfare state. In this essay, it is going to be examined through its long historical path, the formation of the English legal system and its consolidation as a constitutionalist system of Law.
