O licenciamento ambiental à luz do estado de direito socioambiental.

RESUMO

Em um cenário global e local marcado pela crise socioambiental, o Estado de Direito Socioambiental irrompe com a missão de proteger e assegurar direitos fundamentais em todas as suas dimensões. Neste contexto, o presente artigo se propõe a tornar visível como o licenciamento ambiental pode contribuir para a efetivação da missão deste novo Estado. Para tanto, recorre a uma pesquisa bibliográfica e conclui que, na perspectiva jurídica, o licenciamento ambiental é um instrumento fundamental para a efetivação da missão maior do Estado de Direito Socioambiental, pois se sair do papel, pode, de fato, ajudar a definir os contornos de um novo estado e, sobretudo, de uma nova civilização.

ABSTRACT

In a global and local scenario marked by the socio-environmental crisis, the Socio-environmental State of Rights erupts with the mission of protect and secure fundamental rights in all of their dimensions. In this context, this article aims to make visible how the environmental licensing may contribute to the accomplishment of this state’s new mission. To do so, it resorts to a literature research and concludes that, under the legal perspective, the environmental licensing is a key instrument to reach the effectiveness of the most important mission of the Socio-environmental State of Rights, because if it gets “out of the paper” it can indeed help defining the contours of a new state and especially of a new civilization.
