Breves notas sobre a limitação da responsabilidade civil no transporte marítimo de cargas perigosas e substâncias nocivas à luz da convenção hns 2010.

RESUMO

A responsabilidade civil deve limitar e gerenciar o risco das atividades de transporte marítimo de cargas perigosas e substâncias nocivas, diante da conjuntura atual de grande aumento do comércio internacional. Diante desse cenário, este artigo pretende contribuir para a proteção do meio ambiente marinho e do desenvolvimento econômico sustentável da Indústria do Petróleo (transporte), através da introdução dos principais aspectos da Convenção HNS de 1996, que foi aprovada pelo Comitê Jurídico da Organização Marítima Internacional – IMO em abril de 2002, bem como acerca do Protocolo de 2010, que altera a citada convenção. Busca-se, então, a partir da uma breve análise das normas acima, verificar se é relevante a ratificação das mesmas pelo Brasil.

ABSTRACT

The liability shall be limited and manage the risk of the activities of shipping of hazardous and harmful substances, given the current situation of great increase in international trade. Against this backdrop, this article aims to contribute to the protection of the marine environment and the sustainable development of the Petroleum Industry (transport) through the introduction of the main aspects of the 1996 HNS Convention, which was adopted by the Legal Committee of the International Maritime Organization - IMO in April 2002 and on the 2010 Protocol amending the Convention. Seeks, then, from a brief examination of these rules, to check if it is relevant to the ratification of the same by Brazil.
