FEMINICÍDIO: MULHERES VÍTIMAS DO PODER PATRIARCAL OU SUBMISSAS AO AMOR? UM ESTUDO ENTRE A LEI 13104/2015 E LEI 11340/2006

O presente artigo tem por objetivo descrever o crime de feminicídio apresentado no art. 121 do Código Penal Brasileiro, modificado em seu inciso VI e incluido pela lei 13.104/2015. Fazendo analogia usando como base fundamental autoras renomadas como Diana Russel ,Wania Passinatto, Bertha Lutz, Lia Zanotta Machado  entre outras, dando um claro entendimento sobre o assunto e sobre a violência ocasionada da pior forma contra o ser humano , “a sua morte”. O feminicidio nada mais é que a conduta que expressa a morte violenta com características especiais que geralmente não é observada na morte masculina. Como diz em seu inciso VI: contra a mulher por razões da condição do sexo feminino.

ABSTRACT

This article aims to describe the crime of feminicide presented in art. 121 of the Brazilian Penal Code, modified in its item VI and included by law 13.104 / 2015. Making an analogy using as a fundamental basis renowned authors such as Diana Russel, Wania Passinatto, Bertha Lutz, Lia Zanotta Machado among others, giving a clear understanding about the subject and about the violence caused in the worst way against the human being, “his death”. Feminicide is nothing more than the conduct that expresses violent death with special characteristics that is not usually observed in male death. As it says in its item VI: against the woman for reasons of the condition of the feminine sex.
