DIREITO EDUCACIONAL TEMPORÁRIO: SUBSTITUIÇÃO E SUSPENSÃO DAS ATIVIDADES PRESENCIAIS NA EDUCAÇÃO SUPERIOR DURANTE A PANDEMIA DA COVID-19

RESUMO

Objetivos: O artigo visa elucidar os principais pontos constantes das normas de Direito Educacional editadas adotando procedimentos temporários, no âmbito da educação superior – especificamente no sistema federal de educação –, durante o período de duração da pandemia da Covid-19.

Metodologia: Pesquisa documental, acompanhado de análise legislativa autoral, de cunho sistemático. Inclui o estudo da Portaria MEC n.º 544/2020, da Portaria CAPES n.º 36/2020, da Medida Provisória n.º 934/2020 e do Parecer CNE/CP n.º 5/2020.

Resultados: Descreve e esclarece o conteúdo desse conjunto normativo, em termos de limites e possibilidades. Traz, ainda, sugestões e orientações relativas às lacunas existentes.

Contribuições:Contém análise detalhada e aprofundada de tema praticamente intocado na literatura jurídica contemporânea. Elucida o conteúdo dos textos normativos e oferece alternativas concretas e viáveis para atender às exigências contidas no conjunto normativo.

ABSTRACT

Objective: The article aims to elucidate the main points contained in the published Educational Law norms adopting temporary procedures, within the scope of higher education - specifically in the federal education system -, during the duration of the Covid-19 pandemic.

Methodology: Documentary research, accompanied by authoritative legislative analysis, of a systematic nature. Includes the study of Ordinance MEC No. 544/2020, Ordinance CAPES No. 36/2020, Provisional Measure No. 934/2020 and Legal Opinion CNE / CP No. 5/2020.

Results: It describes and clarifies the content of this normative set, in terms of limits and possibilities. It also provides suggestions and guidelines for existing gaps.

Contributions: It contains a detailed and in-depth analysis of a practically untouched theme in contemporary legal literature. It clarifies the content of the normative texts and offers concrete and viable alternatives to meet the requirements contained in the normative set.
