SAÚDE PÚBLICA COLETIVA E MANEJO DE CORPOS DE INDÍGENAS YANOMAMI DURANTE O PICO DA PANDEMIA DA COVID-19: TESTANDO A FÓRMULA DO PESO DE ROBERT ALEXY

RESUMO

Objetivo: O artigo pretende não apenas oferecer uma contribuição para o debate sobre a correção jurídica do modo como indígenas Yanomami foram sepultados durante o pico da Covid-19, mas também, aplicando a fórmula do peso de Robert Alexy a um caso que envolveria uma tensão entre o direito à saúde coletiva da população em geral e o direito cultural do povo Yanomami aos seus ritos funerários próprios, mostrar que a fórmula alexyana não implica, como muitos equivocadamente podem pensar, a confirmação de juízos que profissionais do direito seriam capazes de formular intuitivamente.

Metodologia: Foram compiladas informações sobre o manejo de corpos de indígenas durante a pandemia da Covid-19, mais precisamente sobre a decisão das autoridades do Estado de Roraima de enterrar bebês Yanomami sem a consulta prévia e esclarecida dos pais, a pretexto de cumprirem as medidas de biossegurança necessárias naquela situação. Em seguida, foi formulada na plataforma Google Formulários uma enquete contendo um enunciado que exacerbava os direitos fundamentais que estariam em colisão. A enquete foi aplicada a uma amostragem satisfatória de profissionais das três carreiras jurídicas mais expressivas (magistratura, advocacia e Ministério Público). Ao final, a fórmula do peso alexyana foi aplicada e confrontada com o resultado obtido na enquete.

Resultados: Os resultados alcançados pela enquete e pela aplicação da fórmula do peso foram divergentes entre si. A discrepância entre a resposta dada pelos profissionais de direto consultados e o resultado obtido com a fórmula poderia ser explicada pelo fato de que os profissionais foram provocados a apresentar uma opinião mais intuitiva sobre o caso. E a fórmula revela a fragilidade de juízos intuitivos, mesmo quando sejam expressados por profissionais instruídos.

Contribuições: O artigo busca contribuir para os debates sobre o modo ideal de sepultamento de indígenas durante a pandemia da Covid-19, e sobre o papel da fórmula do peso de Robert Alexy de testar a objetividade de juízos intuitivos em situações de balanceamento entre direitos fundamentais.

ABSTRACT

Objective: This article aims not only to contribute to the debate on the legal correctness of the way Yanomami Indians were buried during the peak of Covid-19 pandemic, but also by applying Robert Alexy’s weight formula to a case that would involve tension between the right to collective health of the people and the cultural right of the Yanomami community to their own funerary rites, to show that the Alexyan formula does not imply, as many mistakenly think, the confirmation of judgments that legal professionals would be able to formulate intuitively.

Methodology: First, data compilation on the handling of the bodies of indigenous people during the Covid-19 pandemic, more precisely on the decision by the authorities of the State of Roraima to bury Yanomami babies without the prior and informed consultation of the parents, under the pretext of complying with the necessary biosafety measures in that situation. Then, a survey was formulated on the Google Forms containing a statement that exacerbated the fundamental rights that would be in collision. The survey was applied to a satisfactory sample of professionals from the three most expressive legal careers (magistracy, advocacy and prosecutors). In the end, the Alexyan weight formula was applied and compared with the result obtained in the survey.

Results: The results achieved by the survey and the application of the weight formula were different. The discrepancy between the answer given by the consulted direct professionals and the result obtained with the formula could be explained by the fact that the professionals were provoked to present a more intuitive opinion about the case. The formula reveals the fragility of intuitive judgments, even when they are expressed by professional lawyers.

Contributions: The article seeks to contribute to the debates on the ideal way of burying indigenous people during the Covid-19 pandemic, and on the role of Robert Alexy’s weight formula to test the objectivity of intuitive judgments in situations of balance between fundamental rights .
