A LIBERDADE DE CIRCULAÇÃO DE TRABALHADORES NA UNIÃO EUROPEIA: DESAFIOS PARA MÁXIMA EFETIVIDADE DOS DIREITOS SOCIAIS

Resumo

Objetivo: Recorre-se à pesquisa exploratória, tendo em vista a busca de remover as fronteiras para o efetivo exercício do direito à liberdade de circulação de trabalhadores, fornecendo um elenco de requisitos que não podem ser impostos pelos Estados-Membros, por se relacionarem a proteções fundamentais dos direitos dos trabalhadores.

Metodologia: Adota-se, metodologicamente, uma abordagem de pesquisa qualitativa, por buscar descrever, compreender, explicar o fenômeno da livre circulação de trabalhadores na União Europeia, a partir da normatização e dos pontos de vista de doutrinadores e jurisprudência dos tribunais.  São utilizados os procedimentos de pesquisa bibliográfica, a partir do estudo em referências teóricas, em meios escritos e eletrônicos.

Contribuições: Esse artigo busca demonstrar que os princípios fundamentais para uma efetiva liberdade de circulação dos trabalhadores na União Europeia não foram adequadamente integrados na legislação nacional, criando uma discrepância entre a União Europeia e a prática na liberdade de prestação de serviços, o que prejudica o escopo de se manter um mercado único.

ABSTRACT

Objectives: Exploratory research is used with a view to seeking to remove borders for the effective exercise of the right to freedom of movement for workers, providing a list of requirements that cannot be imposed by Member States, as they relate to fundamental protections workers' rights.

Methodology: A qualitative research approach is adopted methodologically, as it seeks to describe, understand and explain the phenomenon of free movement of workers in the European Union, based on the norms and the points of view of legal professors and jurisprudence from the courts. Bibliographic research procedures are used, based on the study of theoretical references, in written and electronic media.

Contribuitions: This article seeks to demonstrate that the fundamental principles for effective freedom of movement for workers in the European Union have not been adequately integrated into national legislation, creating a discrepancy between the European Union and the practice in the freedom to provide services, which undermines the scope of maintain a single market.
