CONSTITUCIONALISMO GLOBAL, DIREITOS HUMANOS E LITIGÂNCIA CLIMÁTICA

Resumo

RESUMO

Objetivo: O presente artigo tem como finalidade discutir como a abordagem policêntrica e a teoria do constitucionalismo global podem contribuir para a criação de modelos jurídicos que promovam uma efetiva proteção dos direitos humanos afetados pela mudança climática, especialmente, estimulando o debate publico e a multiplicação de ações através da litigância climática.

Metodologia: Esta pesquisa utiliza-se de uma abordagem qualitativa, com vertente exploratoria, de procedimentos de pesquisa bibliográfica e documental, por meio de libros, artigos científicos e tratados internacionais pertinentes ao tema.  

Resultados: A multiplicação de litígios climáticos pode ser passível de críticas, considerando a possibilidade de seu “efeito boomerang”, é dizer, a reticência de determinados Estados-nação em assumir compromissos internacionais, especialmente, para estabelecer suas metas de mitigação, considerando a potencial exposição a esse modelo de demanda. Entretanto, é necessário compreender que a teoria do constitucionalismo climático global assume a condição de instrumento de proteção contra essas respostas dadas pelo sistema em vigor no mundo globalizado, caracterizado pela convergência de políticas e estruturas econômicas impostas por grandes corporações internacionais e pelos mercados financeiros.

Contribuições: O trabalho com a evolução institucional dos vínculos existentes, o regime internacional climático e o sistema internacional de direitos humanos e a necessidade de um maior aprofundamento do debate em diferentes esferas de poder, com adoção de medidas concretas para a amenização de seus efeitos negativos. Em tal contexto, a litigância climática surge como um caminho policêntrico para encorajar atores governamentais e não-governamentais a multiplicar suas ações de combate à crise climática.

ABSTRACT

Objective: the present article aims to contribute to the discussion of how the polycentric approach and the theory of the global climate constitutionalism could contribute to the elaboration of legal patterns that promote an effective protection of the human rights affected by climate change, specially, stimulating the public debate and the multiplication of action through the climate litigation.

Methodology: This research uses a qualitative approach, with an exploratory aspect, of bibliographic and documentary research procedures, through books, scientific articles and international treaties relevant to the theme.

Results: The multiplication of climatic disputes can be subject to criticism, considering the possibility of its “boomerang effect”, that is, the reticence of certain nation-states in making international commitments, especially to establish their mitigation goals, considering the potential exposure to this demand model. However, it is necessary to understand that the theory of global climate constitutionalism assumes the condition of an instrument of protection against these responses given by the system in force in the globalized world, characterized by the convergence of policies and economic structures imposed by large international corporations and the financial markets.

Contributions: The work with the institutional evolution of existing links, the international climate regime and the international human rights system and the need for further deepening the debate in different spheres of power, with the adoption of concrete measures to mitigate its negative effects . In such a context, climate litigation emerges as a polycentric way to encourage governmental and non-governmental actors to multiply their actions to combat the climate crisis.
