FUNDAMENTOS DA LGPD: CÍRCULOS CONCÊNTRICOS E SOCIEDADE DE INFORMAÇÃO NO CONTEXTO DE DIREITOS DA PERSONALIDADE

Resumo

RESUMO

Objetivos: a presente pesquisa tem como ponto central os fundamentos da Lei Geral de Proteção de Dados (LGPD) e os seus impactos nos direitos da personalidade. Os fundamentos foram acoplados em três blocos distintos para efeitos didáticos. O estudo tem por referencial teórico o pensamento de Heinrich Hubmann e Heinrich Henkel que desenvolveram a Teoria dos Círculos Concêntricos.

Metodologia: o estudo se vale da pesquisa exploratória para investigar o problema da proteção de dados pessoais sob o viés da disciplina de direito de personalidade, em especial a privacidade, intimidade e sigilo, no contexto da Lei Geral de Proteção de Dados (LGPD). A pesquisa se utilizou da revisão bibliográfica em bases de dados de revistas especializadas, doutrina e legislação sobre o tema proposto. O método proposto é o hipotético dedutivo para investigar o problema da proteção de dados pessoais.

Resultados: O trabalho mostra que a teoria precisa ser revista para que atenda às necessidades da atual sociedade de informação. Assim, propõe uma resposta ao problema da invasão da esfera pública nas esferas dos círculos concêntricos a partir da sugestão da sua reestruturação e uma nova leitura dos mesmos. O trabalho conclui que a movimentação das esferas exige uma ação não apenas do Poder Público em termos de legislação e políticas públicas, mas também da comunidade a fim de que dados pessoais não sejam compartilhados indiscriminadamente.

Contribuições: O presente estudo traz como contribuição o debate de um tópico muito atual e sensível, que é a investigação da proteção de dados pessoais sob o viés da disciplina de direito de personalidade, em especial a privacidade, intimidade e sigilo no contexto da proteção de dados pessoais, cuja legislação pátria foi tardiamente promulgada em relação a muitos outros Estados, principalmente os europeus, por conta da complexidade do tema e dos interesses envolvidos.

ABSTRACT

Objectives: this research has as its central point the fundamentals of the General Data Protection Law (LGPD) and its impacts on personality rights. The fundamentals were coupled in three distinct blocks for didactic purposes. The study has as a theoretical reference to the thinking of Heinrich Hubmann and Heinrich Henkel, who developed the Theory of Concentric Circles.

Methodology: the study draws on exploratory research to investigate the problem of protection of personal data under the bias of the personality law  discipline, especially privacy, intimacy and secrecy in the context of the General Data Protection Law (LGPD). The research used the bibliographic review in databases of specialized journals, doctrine and legislation on the proposed theme. The proposed method is the hypothetical deductive to investigate the problem of protection of personal data.

Results: the paper shows that the theory needs to be revised to meet the needs of today’s information society.it proposes an answer to the problem of the invasion of the public sphere in the spheres of concentric circles from the suggestion of its restructuring and a new reading of them. The study concludes that the movement of the spheres requires action not only by the public power in terms of legislation and public policies, but also by the community so that personal data are not shared indiscriminately.

Contributions: The present study contributes to the debate on a very current and sensitive topic, which is the investigation of the protection of personal data under the bias of the personality right discipline, in particular privacy, intimacy and secrecy in the context of personal data protection, in which thennational legislation was belatedly enacted in relation to many other States, mainly Europeans, due to the complexity of the topic and the interests involved.
